• All of the services provided under the "eHire" system are the exclusive property of QIANJIN NETWORK INFORMATION TECHNOLOGY (SHANGHAI) COMPANY LIMITED (前锦网络信息技术(上海)有限公司, hereinafter referred to as “51job”).
  • The services provided under the "eHire" system are to be utilized by companies (hereinafter referred to as "Members") with recruitment needs. Individuals or other visitors to the system must accept and abide by the terms and conditions laid out in this user agreement before becoming a Member of the "eHire" system. If the individual or visitor does not accept these terms and conditions, the registration process is incomplete and membership to the system is denied. The terms and conditions laid out below become immediately effective once you click on the "I have read the service terms and conditions” statement during the registration process which indicates that you fully accept the provisions in this agreement. 51job retains the right to revise and modify the terms and conditions as needed and notifying members of such changes afterwards.
  • Upon successfully completing registration and becoming a Member, a username and password to the system will be provided. Members may change the password at any time. Members are fully responsible for safeguarding their usernames and passwords. The username and password may not be transferred, sold or shared with others. A Member is fully responsible for all activities and actions related to the username and account that was provided to the Member. If a Member discovers any illegal use or security breach of the account, please immediately notify 51job. 51job does not assume any responsibility for a Member account which has been hacked, negligently managed or whose passwords have been illegally used.
  • 1. Copyright
  • All of the content and graphics in the "eHire" system are under the protection of the Copyright Law of the People’s Republic of China and other relevant copyright, trademark and intellectual property right laws, regulations and agreements entered into internationally by the People’s Republic of China. All of the content in the “eHire” system is considered to be the exclusive property of 51job. The content may not be copied, replicated or used in any way by a third party without the permission of 51job. Members are strictly prohibited from using any of the information found in the "eHire" system and on 51job.com for any public or commercial purposes without the prior written consent of 51job, even if the content is kept in their original format and layout without any changes or modifications.
  • Members may not copy the web pages and HTML files created by 51job. 51job possesses the copyright of all its HTML files. In addition, all icons, graphics, diagrams, text, design, software, data, etc. in the “eHire” system is the copyright material of 51job, and 51job has the proprietary right to use and distribute the information. Members may not copy, use, reprint or provide information to any other third party without 51job's prior consent.
  • The 51job.com trademarks are the property of 51job. The trademarks of 51job’s partners that appear on 51job.com are the property of the 51job partners. Without the prior written consent of 51job and/or the 51job partners, the trademarks may not be copied or used in any way.
  • 2. Distribution of Information
  • Members may not use the “eHire” system to post, distribute or save information that is in violation of any applicable laws or regulations in the People's Republic of China and in other countries. Members are also prohibited from using the "eHire" system to infringe on the copyright, trademark, trade secret, patent or other intellectual property rights of another party. Also, Members shall not violate the public and individual rights to privacy nor post or distribute any information that is illegal, harassing, slanderous, abusive, intimidating, harmful, vulgar or otherwise offensive. Members may not distribute any information unsuited to the purpose of recruitment or job search, nor distribute any incomplete, inaccurate, false or misleading information. Members are held liable for the information that they release through the "eHire" system and must take full responsibility for any disputes or lawsuits that may arise as a result of the information that they have disseminated.
  • If a Member is in violation of the above condition, 51job has the right to require the Member to correct such violation or to take any direct necessary measures to remedy the violation itself (including but not limited to, the deletion of the Member’s posted information and the suspension or termination of the Member’s use of online services). Service fees paid by a Member whose online services have been terminated as a result of improper behavior are not refundable.
  • In order to verify the qualifications and authenticity of Members, 51job reserves the right to request and obtain from Members relevant certification materials (such as a copy of a business license affixed with company seal, etc.). Members also agree to be fully liable for all information they distribute. If information distributed by a Member is in violation of the provision of this agreement or infringes on any third party’s legitimate rights, the Member shall be fully responsible for any disputes. 51job does not assume any responsibility.
  • 3. Use of Information
  • Members' use of candidate information disclosed in resumes shall be restricted to the purpose of recruitment only. Members agree not to use the information, including but not limited to, in the following ways: (a) Provide information or methods to competitors of 51job to obtain business contacts with employers or engage in actions and activities against 51job; (b) Modify or delete information distributed by 51job or others; (c) Transfer, distribute, disclose or sell personal information or data from 51job.com to a third party; (d) Use the name of an employer or purpose of recruitment to carry out illegal activities (such as SMS fraud, false advertising, pornography, etc.); (e) Commit any other illegal or improper activities which are detrimental to the commercial interests of 51job.
  • Members are authorized to use the "eHire" system to search the resume bank maintained at 51job.com. However, access to and use of candidate resumes and information should be restricted to the purpose of recruitment only.
  • Members may not utilize any crawling software or online tools on candidate resumes or information at 51job.com. Members will not be allowed to view more than 500 complete candidate resumes (with contact information included) in one day. 51job has the right to analyze a Member's activity according to resume views and data amount to assess the purpose of database usage and to determine any suspension and termination of service.
  • Members shall not use the information available through the "eHire" system for any commercial purposes.
  • 4. Retention of Information
  • a. Information distributed through the “eHire” system will be retained for 18 months (from the last date of validity).
  • b. Candidate resumes managed in the “eHire” system will be retained for 18 months (from the date the resume was received).
  • c. Candidate resumes downloaded from the resume search service in the “eHire” system will be retained for 18 months (from the date of download).
  • 5. Disclosure of Information
  • 51job shall not disclose information about Members without their prior consent unless as follows: (a) The Member authorizes 51job to disclose the information; (b) 51job is bound by legal obligation to disclose the information; (c) The information has been posted or released by the Member; (d) The information is deemed to be public information; (e) Member information is leaked, lost, stolen or tampered with that is a result of hacking, computer viruses, government regulation that temporarily shuts down or affects normal network operations and other force majeure events.
  • 51job fully respects the rights of Members and shall not edit or change any of their information without prior approval unless specific legal and public security concerns require such actions. 51job reserves the right of judgment as to whether a Member has been in violation of the terms and conditions as set forth in this agreement.
  • If a Member is deemed to have violated the terms and conditions set forth here, 51job will notify and require the Member to cease such behavior. This notification can be delivered either by email or through a public bulletin in the "eHire" system. The notification is considered served on the day that the email is transmitted or that the public bulletin is posted. Notifications for modifications and changes made to the terms and conditions of service, legal notice and other agreements may be communicated in such a way to Members.
  • Information made public on 51job.com may be seen by any number of visitors to the website and can potentially be misused by these visitors. Members should be aware of the possibility of such an occurrence and agrees not to hold 51job liable in any way, legal or otherwise, for any misuse of their information by third party visitors to the website. 51job will not be held liable or responsible by Members for the wrongful actions of third party visitors.
  • 6. Integrity of Information
  • Members shall be responsible for the integrity (i.e. truthfulness, accuracy and completeness) of the information posted on the "eHire" system and related links and pages.
  • 51job cannot guarantee that all information posted by Members or provided by other third parties is entirely truthful, accurate and complete. Members acknowledge that they are aware that any information found in the "eHire" system and related links and pages must be verified further if they plan to re-use the information in any way. 51job will not be held liable or responsible by Members for any loss or damage that results from the use of unverified information.
  • 7. Security of Information
  • Members shall not violate or plan to violate any of the security measures undertaken by 51job and in effect at 51job.com. Actions deemed to be in violation include but are not limited to: unauthorized access to confidential data, servers or accounts without permission; attempt to probe, exploit and test potential weaknesses in the system or network to undermine or nullify security measures without permission; attempt to interfere with the provision of services to Members and the network, using tactics such as overloading and "mail bombing" or other destructive methods; send spam emails to promote and advertise products or services; create false TCP/IP data packs to destroy the system or network
  • Upon discovery, 51job has the right to terminate all functions within a Member’s account and to cease providing any service to all other users associated to the Member’s company. 51job also has the right to investigate and take legal actions to prevent such behavior and cooperate with the pertinent law enforcement agencies to prosecute perpetrators.
  • 8. Modification and Deletion of Information
  • The right to modify and delete information rests with the party that originally created the information. However, 51job reserves the right to modify or delete certain information found to be unsuitable or inappropriate.
  • Although a confidentiality clause is in effect in this agreement, Members recognize and agree that 51job reserves the right to provide statistical information in aggregated form to third parties as long as individual Member name is not released.
  • 9. Privacy policy
  • To use the services of the Website, when you register and use a corporate recruitment account on behalf of your employer, we collect information about your name, ID number, facial recognition information and phone number, which we use to confirm your identity. For the specific terms regarding to personal information security and privacy protection, please refer to the related content of 51job Privacy Policy (Link: https://www.51job.com/bo/service.php#3). Please carefully read and fully understand the whole content of this Privacy Policy before using the services and make sure that you understand the rules of the Website regarding the treatment of users' personal information.
  • 10. Online Purchase
  • When Members utilize a third party transaction system to pay for services, the price for services purchased shall be the price publicized on the 51job website at the time of purchase. Upon the completion of payment, 51job will not provide a refund for any reason.
  • If in the event of force majeure, the fault of the third party transaction system, or another reason not within the control of 51job that results in an online transaction not being completed, a system failure on the website, or abnormalities or information loss during the purchase process, 51job does not assume any responsibility but will assist with the situation as reasonably possible.
  • 11. Responsibilities
  • 51job may not supervise the “eHire” system at all times, but reserves the right to monitor it in real time. 51job does not assume responsibility for any information inputted by another party or not distributed by 51job. Members shall bear all legal liabilities wholly and independently for all information the Members distribute in the job postings database.
  • 51job does not guarantee a certain number of user views for each job posting, and there is no guarantee that a specific user will browse a job posting. 51job assumes no responsibility for any other websites linked to content on 51job.com. 51job does not guarantee that the “eHire” system will be able to operate without error for long periods of time nor that its servers are immune to viruses or other mechanical failures. If in the course of using the www.51job.com website that a Member is required to repair or replace equipment or suffers data loss, 51job does not assume any responsibility for any loss incurred by the Member. 51job does not assume any responsibility if its website cannot be accessed due to normal system maintenance, system upgrades or network congestion. 51job and its management, employees and agents do not assume any responsibility for any loss incurred by a Member due to the use of www.51job.com and content from the website, or due to the inability to use www.51job.com.
  • Unless otherwise required by law, the maximum responsibility (including breach of contract or contract infringement) undertaken by 51job under this agreement is the amount of service fees collected. 51job does not assume any responsibility for any direct or indirect benefits or losses of Members.
  • 12. Suspension and Termination of Service
  • Members that have violated the service terms and conditions as outlined in this agreement or conducted illegal activities will be notified in writing via regular mail or email. Suspension or termination of service will be at the discretion of 51job. Under special, urgent or certain conditions deemed significant by 51job (i.e. repeat offenders), 51job may suspend or terminate service to a Member without advance notice. Service fees collected from a Member whose service has been terminated is not refundable. 51job also reserves the right to terminate any free or trial service with or without advance notice.
  • 13. Risks
  • Members shall be solely responsible for all the risks related to logging into the "eHire" system and/or logging into other websites through the www.51job.com website or system. Members recognize and agree that 51job shall not be responsible for the consequences of any information exchange that they take on while conveying recruitment or application intentions or establishing employer and employee relations. Members shall be solely responsible for their own actions and consequences arising from those actions. In the event that third party claims and lawsuits arise against 51job as a result of actions taken by a Member, the Member is obligated to assist with and fully cooperate in the defense of 51job to avoid any adverse monetary impact or damage to 51job’s reputation. If the Member is delinquent or fails to provide the required assistance and cooperation, 51job has the right to take defensive measures on its own behalf (including but not limited to retaining legal representation, etc.) and the associated fees and costs thereafter shall be borne by the Member.
  • 14. Changes to the User Agreement
  • If 51job decides to amend the user agreement, 51job will announce the changes on its website. Unless a Member notifies 51job that it does not accept the changes and will cease to use services, 51job shall assume the changes are accepted by Members and Members shall continue to use the services at the 51job website under the new terms and conditions. 51job shall not be liable for inconvenience or loss (if any) incurred by Members caused by changes to the user agreement.
  • 15. Dispute Resolution
  • All disputes between Members and 51job shall be settled through friendly negotiations. If the two parties fail to reach an agreement after the negotiations, the dispute shall be submitted for arbitration by the Shanghai Arbitration Committee.
  • 16. Force Majeure
  • Neither party shall not be responsible for loss incurred due to failure to perform the obligations specified in this agreement due to earthquake, typhoon, wars, strikes, government actions, fires not caused by either party, accidents of telecommunication or other unforeseen, uncontrollable force majeure. In the event of nonperformance as a result of force majeure, the party affected shall communicate the reason for failure or delayed execution of its obligations and provide the other party with evidence of its inability to perform the obligations. The two parties shall negotiate and come to an agreement on whether the terms of service should be terminated or nullified or revised.
  • The terms and conditions of service as outlined in this user agreement are in accordance with the relevant laws and regulations in enforcement in the People’s Republic of China. In the event that any conflicts arise, the governing laws and regulations will take effect. Members and 51job agree to these terms and conditions of service.
  • The Chinese language version of the terms and conditions of the user agreement shall prevail over this English translation in the event of any conflict or dispute.
